Americans to get up to $90 from $3.5m data breach settlement - no proof needed

AMERICANS are set to receive up to $90 as part of a massive $3.5million data breach settlement - and they can get it without proof.

The case alleges that this took place over a number of years, and now Americans stand to benefit from it.

Virginia Mason Medical Center has agreed to pay the fee after being accused or sharing patient portal data with third parties.

These include the likes of Google and Facebook, per Top Class Actions.

This supposedly happened without patient consent, and under the terms, which directly violates Washington state law.

Those eligible can receive a cash payment based on their portal usage.

Virginia Mason Medical Center is is a Seattle-based hospital that offers a range of health services.

These include Primary care, cancer treatment and surgery.

If the $3.5million is not enough to cover all of the claims, Virginia Mason Medical Center has agreed to pay an additional fee of up to $3.25million.

The settlement benefits those who logged into the MyVirginiaMason patient portal between October 10, 2015, and May 18, 2023.

Those who did can receive up to $90, and those who used the public website can receive $45.

It applies to Washington residents who logged into their patient account, or the public website address www.virginiamason.org.

Payments may be adjusted on a pro-rata basis depending on the number of claims filed.

Pro-rata means in equal proportions, suggesting that if there too many claims to cover the initial $3.5million, claimants could receive more cash from the settlement.

Aside from the monetary benefits, Virginia Mason Medical Center has also agreed to create a Web Governance Committee to assess the use of analytics on its web properties.

For two years after final approval of the case, Virginia Mason will not use certain tracking technologies.

This is unless the committee makes the request under federal law.

As a result, Virginia Mason Medical Center will have to change its policy towards the implementation of certain technologies it uses.

There is no proof of purchase in this case, meaning you do not have to provide anything in order to submit a successful claim.

For those looking to grab their share of the cash, they should submit a form as soon as possible to do so.

Class members must submit a valid claim form by April 28, 2025.

The deadline for exclusion is March 28, 2025, which is the final date that the accused can object to any of the terms.
