Alan Dershowitz Pans Trump's Wall Street Journal Lawsuit

Alan Dershowitz doesn't think much of President Donald Trump's lawsuit against The Wall Street Journal.

On Monday, the newspaper published an alleged drawing by Trump that it first reported on in July. The Journal said that Trump sent the doodle as part of birthday well-wishes to his friend, Jeffrey Epstein, in 2003. The doodle shows a woman's torso, inside of which is an imaginary cryptic dialogue between Trump and Epstein that ends with Trump saying, "Happy Birthday - and may every day be another wonderful secret."

Epstein was later revealed to be a child sex trafficker. The president denies that the message is his handiwork and is suing the Journal and owner Rupert Murdoch for libel. He is seeking $10 billion.

Dershowitz, a former lawyer for Epstein and the president, appeared on Monday's edition of Bolling! and offered his view of Trump's lawsuit.

"It depends on whether the note is authentic," Dershowitz said. "I don't think Trump, in the end, will win this lawsuit because he would have to prove that The Wall Street Journal engaged not only in defamation, but malicious defamation. There has to be malice. And if The Wall Street Journal has a basis for making the statement, then they will prevail even if the statement was false and defamatory. So, it's a very hard barrier to overcome if you're a public figure."

Host Eric Bolling replied by asking, "Is there something at play here where Trump can get a win out of this, telling Murdoch, 'Ok, so maybe you're right, but it's gonna cost you a lot more to go through with the lawsuit than settle with me'?"

"If I had to make a prediction, I would say no," Dershowitz responded. "I would say that the lawyers for The Wall Street Journal are telling Murdoch that they really have no chance of losing this. So, I don't think we'll see a settlement. You know, it's possible that they'll put some change on the table to avoid having to go to court. But I'm not even sure this will survive a motion to dismiss."

He concluded, "I don't think this lawsuit is going anywhere."
